The NextofKin App (the "App," "Service," "we," "us," or "our") is owned and operated by Marsh IT LLC, a New York limited liability company, doing business as The NextofKin App. This Privacy Policy describes how we collect, use, share, and protect personal information when you use our mobile applications, our website at thenextofkinapp.com, and related services (collectively, the "Service").
By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Service.
Quick Summary
We collect only the information needed to operate The NextofKin App.
We do not sell your personal information.

Estate Planning Content You Provide
- Information about your digital assets (account names, access instructions, -recovery notes)
- Beneficiary names, contact information, and inheritance instructions
- Notes you input
- NokCheck preferences and emergency contact details
Payment Information
We use Stripe, Inc. as our payment processor. Stripe collects and stores your full payment card information directly; we do not store full card numbers or bank account information on our servers. Stripe is PCI-DSS Level 1 compliant. Stripe's privacy practices are described at https://stripe.com/privacy.
Mobile Device and Technical Information
Device type, operating system, and app version
- IP address
- General location (city/region level, derived from IP address)
- Crash reports and diagnostic data
Usage Data
- Features and pages accessed within the Service
- Time, date, and duration of activity
- Aggregated and anonymized analytics data
2. How We Use Your Information
We use your information to:
- Create and operate your account
- Authenticate you when you sign in
- Send transactional SMS messages (only if you have opted in), including check-in reminders, account alerts, and NokCheck notifications
- Process payments and manage your subscription
- Communicate with you about your account, security, and changes to the
Service
- Improve the Service, debug issues, and develop new features
- Detect, prevent, and respond to fraud, abuse, or security incidents
- Comply with legal obligations and enforce our Terms of Service
3. How We Share Your Information
Service Providers
We share limited personal information with vetted third-party service providers who help us operate the Service. Each provider is contractually obligated to use your information only to deliver services to us.

Mobile Information and SMS Data — Required Disclosure
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Phone numbers, SMS opt-in records, and consent data collected by The NextofKin App are used exclusively to:
- Deliver the SMS messages you have explicitly requested
- Honor opt-out requests in compliance with applicable law
- Maintain consent and opt-out records required by mobile carriers and TCPA regulations
We do not sell, rent, lease, or share your phone number, your SMS consent record, or the content of SMS messages with marketers, data brokers, or any affiliate for marketing or promotional purposes.
Beneficiary Disclosure (Estate Planning Context)
By using the NokCheck and beneficiary features, you instruct and authorize us to share specific estate planning content you have designated with the beneficiaries you have named — but only after the NokCheck verification process you have configured has been triggered and completed according to your settings. We will not share this content with anyone outside the process you have explicitly authorized.
Legal Requirements
We may disclose information if we believe in good faith that disclosure is required by law, court order, subpoena, or other valid legal process, or is necessary to:
- Protect the rights, property, or safety of our users, the public, or us
- Investigate fraud or security incidents
- Enforce our Terms of Service
Business Transfers
If Marsh IT LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will provide notice (by email or a prominent notice on the Service) before your information becomes subject to a different privacy policy.
We Do Not Sell Personal Information
We do not sell personal information as that term is defined under the California Consumer Privacy Act (CCPA) or California Privacy Rights Act (CPRA).
4. Data Retention and After-Death Handling
We retain your information for as long as your account is active or as needed to provide the Service.
Because The NextofKin App is purpose-built to provide continuity of digital estate information, your account content may persist beyond your lifetime according to the beneficiary instructions and NokCheck settings you have configured. This is a core feature of the Service, not an unintended retention.
You may delete your account at any time from the in-app account settings or by contacting hello@thenextofkinapp.com. Upon deletion request, we will permanently remove your data within 30 days, except where retention is required by law (for example, tax records, fraud investigation, or pending legal matters) or where data has already been delivered to a beneficiary per your authorized NokCheck instructions.
Automatic deletion of accounts without an active subscription
To keep the Service secure and our records current, accounts that do not have an active paid subscription may be scheduled for automatic deletion after a limited retention period.
If your account does not have an active subscription, a retention period of approximately 30 days may apply, after which the account may be automatically deleted. We will always warn you first before any automatic deletion. We will send an email to the address on your account letting you know it is scheduled for removal, giving you notice to act. You can stop the deletion at any time before it takes effect — by starting a subscription, or by contacting us at hello@thenextofkinapp.com.
If no action is taken by the end of the notice period, your account and its associated data will be permanently deleted, except where longer retention is required by law (for example, tax records, fraud investigation, or pending legal matters), or where information has already been delivered to a trusted contact or beneficiary in accordance with your authorized NokCheck instructions.
This automatic deletion applies only to accounts that do not have an active subscription, and is separate from the account deletion you may request yourself at any time described above.
5. Security
We use industry-standard administrative, technical, and physical safeguards to protect your information, including:
- TLS encryption in transit
- AES-256 encryption at rest for sensitive content
- Role-based access controls and least-privilege internal access
- Logging and monitoring of access to sensitive data
- Regular security review and patching
No internet-based service can guarantee perfect security. We strongly recommend that you use a strong, unique password and enable any available account security features.
6. Your Privacy Rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you
- Correct inaccurate or incomplete information
- Delete your personal information
- Opt out of certain processing or data sharing
- Receive a copy of your data in a portable, machine-readable format
- Withdraw consent at any time where processing is based on consent
California Residents (CCPA / CPRA)
California residents have the rights listed above, plus the right to non-discrimination for exercising those rights. We do not sell personal information.
To exercise any of these rights, contact us at hello@thenextofkinapp.com with the subject line "Privacy Request." We will verify your identity before responding and will respond within the time required by applicable law (generally 45 days under CCPA).
7. SMS Messaging Specifics
If you opt in to SMS messaging from The NextofKin App:
- Message frequency varies based on your account activity and settings.
- Message and data rates from your mobile carrier may apply.
- Reply HELP for help.
- Reply STOP at any time to opt out. Opt-out is honored immediately and at no cost.
- Your phone number, consent record, and opt-out record are retained for a minimum of 4 years for compliance and audit purposes, as required by mobile carriers and applicable regulations.
For the avoidance of doubt — and as stated in Section 3 above — we do not share your phone number or SMS data with third parties or affiliates for marketing or promotional purposes.
8. Children's Privacy
The Service is not directed to and may not be used by children under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided personal information to us, please contact hello@thenextofkinapp.com and we will promptly delete it.
9. Third-Party Links and Services
The Service may contain links to third-party websites, services, or applications. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any information.
10. International Users
The Service is operated from the United States. If you access the Service from outside the United States, your information will be transferred to, stored in, and processed in the United States. The data protection laws of the United States may differ from those of your country.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email (to the address associated with your account) and/or by posting a prominent notice within the Service before the change takes effect. The "Last Updated" date at the top of this Policy indicates when it was last revised.
Your continued use of the Service after a revised Privacy Policy takes effect constitutes your acceptance of the revised terms.
