The NextofKin App (the “App,” “Service,” “we,” “us,” or “our”) is owned and operated by Marsh IT LLC, a New York limited liability company, doing business as The NextofKin App. This Privacy Policy describes how we collect, use, share, and protect personal information when you use our mobile applications, our website at thenextofkinapp.com, and related services (collectively, the “Service”).
By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Service.

We use Stripe, Inc. as our payment processor. Stripe collects and stores your full payment card information directly; we do not store full card numbers or bank account information on our servers. Mobile Device and Technical Information
Newsletter
If you sign up for our newsletter, we collect the email address you give us and a record of your consent — when you confirmed it, which page you signed up from, and your click on the confirmation email. You do not need an account to subscribe, and creating an account never subscribes you.
Every newsletter carries an unsubscribe link, which removes you from the list. If you would like the address erased entirely, write to hello@thenextofkinapp.com.

Service Providers
We share limited personal information with vetted third-party service providers who help us operate the Service. Each provider is contractually obligated to use your information only to deliver services to us.
Mobile Information and SMS Data — Required Disclosure
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Phone numbers, SMS opt-in records, and consent data collected by The NextofKin App are used exclusively to:
When you name someone as a trusted or emergency contact, you authorize us to use the contact details you provide in order to send them an invitation email asking whether they are willing to be named, and — if you have an active subscription and you stop responding to NokCheck check-ins — to send them a message asking whether they have heard from you. We do not send them your plan. No part of your plan content is visible to, or delivered to, any contact — unless you yourself choose to share it, or set up a release. Both are yours to turn on, and nothing is on unless you turn it on. We never sell the contact details you provide, and we never use them for marketing or share them with advertisers or data brokers. We use them only for the purposes described above. If that ever changes, we will update this Policy and notify you before the change takes effect.

Business Transfers
If Marsh IT LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will provide notice (by email or a prominent notice on the Service) before your information becomes subject to a different privacy policy.
We Do Not Sell Personal Information
We do not sell personal information as that term is defined under the California Consumer Privacy Act (CCPA) or California Privacy Rights Act (CPRA).
We retain your information for as long as your account is active or as needed to provide the Service.
Your account content remains in your account for as long as your account remains active. If your account becomes inactive, we follow the notice and deletion process described below. Your content is not transferred or delivered to anyone by us. The only ways it can ever reach someone are the sharing choices you make yourself.
You may delete your account at any time from the in-app account settings or by contacting hello@thenextofkinapp.com. Upon deletion request, we will permanently remove your data within 30 days, except where retention is required by law (for example, tax records, fraud investigation, or pending legal matters).
Automatic deletion of accounts without an active subscription
To keep the Service secure and our records current, accounts that do not have an active paid subscription may be scheduled for automatic deletion after a limited retention period.
If your account does not have an active subscription, a retention period of approximately 30 days may apply, after which the account may be automatically deleted. We will always warn you first before any automatic deletion. We will send an email to the address on your account letting you know it is scheduled for removal, giving you notice to act. You can stop the deletion at any time before it takes effect — by starting a subscription, or by contacting us at hello@thenextofkinapp.com.
If no action is taken by the end of the notice period, your account and its associated data will be permanently deleted, except where longer retention is required by law (for example, tax records, fraud investigation, or pending legal matters).
This automatic deletion applies only to accounts that do not have an active subscription, and is separate from the account deletion you may request yourself at any time described above.

No internet-based service can guarantee perfect security. We strongly recommend that you use a strong, unique password and enable any available account security features.

California residents have the rights listed above, plus the right to non-discrimination for exercising those rights. We do not sell personal information.
To exercise any of these rights, contact us at hello@thenextofkinapp.com with the subject line “Privacy Request.” We will verify your identity before responding and will respond within the time required by applicable law (generally 45 days under CCPA).
If you opt in to SMS messaging from The NextofKin App:
For the avoidance of doubt — and as stated in Section 3 above — we do not share your phone number or SMS data with third parties or affiliates for marketing or promotional purposes.
If you turn on check-in calls, The NextOfKin App may place automated, prerecorded telephone calls to the number you provide. Calls are never turned on by default, and consent to calls is separate from consent to text messages — agreeing to one does not agree to the other.

Consent to calls is not required to use the app. Standard carrier charges may apply. Calls are delivered by Twilio Inc.
The Service is not directed to and may not be used by children under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided personal information to us, please contact hello@thenextofkinapp.com and we will promptly delete it.
The Service may contain links to third-party websites, services, or applications. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any information.
The Service is operated from the United States. If you access the Service from outside the United States, your information will be transferred to, stored in, and processed in the United States. The data protection laws of the United States may differ from those of your country.
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email (to the address associated with your account) and/or by posting a prominent notice within the Service before the change takes effect. The “Last Updated” date at the top of this Policy indicates when it was last revised.
Your continued use of the Service after a revised Privacy Policy takes effect constitutes your acceptance of the revised terms.
